Barclay Towers under the table
We have been timeshare owners at Barclay Towers in Virginia Beach since about 1985. We found to our dismay, being chartered members, that the timeshare office had rented our our timeshare, when we were a no show the first day due to family. When asked why she had rented out the space, she said she was just trying to help us with our maintenance fee. I told her that it was illegal, as we hadve ownership and were not notified or asked. I was also told I could not have an current list of the Board of Directors for the Timeshare Owners Association, that it was privy info. Dah! Do you think as an owner i might be that group, I guess not. Smells bad!!!!!

This is downright unethical as you OWN the week. If you didn't show up all week, then that's your prerogative and the resort had no right to rent it. Many people who own weeks don't use the entire week, they use part of the week with check-in later in the week.
You need to get in touch with the highest tier management of that resort and report this incident. You are, by law, entitled to names/addresses/telephone numbers of the HOA of your resort. The person who rented your week should be fired.
Please keep us informed of this situation.

However, they seemed to have plenty of rentals available and wanted to charge us if we wanted a bigger room. I guess they figure most owners will never know the differencejudithp37 wrote:We have been timeshare owners at Barclay Towers in Virginia Beach since about 1985. I am the person that rented this timeshare. This owner has NEVER paid her maintenance fee to the resort as her acct goes to collection each and every year, forcing the Assn. to pay 1/3 of the fee to the attorney. On checking with the atty. on Friday afternoon prior to Saturday check in, I was told the fee was not paid. I then put the unit up for rent with the proceeds earmarked to go first to delinquent fees and any balance to go to Owner. she went to the atty about 4 pm and paid the fee Friday afternoon - again the resort only rec'd 2/3's of this fee. In addition, the names and numbers of our BOD are in our newsletters twice a year. They are also available thru the State Corp. Commission free of charge to anyone who cares to look - this owner is obviously not unfamiliar with the Interent as she has broadcatsed her allegedly mistreatment in every forum she can find. Owner was furnished with the name of the management company and would have been given the names of the board members had she asked for them. I do not give out their personal emails, home numbers or addresses per BOD request. A complaint letter this Owener wrote was forwarded to me and it was given to the President of the management company, the manager of the resort and the BOD. I don't know about the rest of you who pay your fees on time, but I am tired of delaing with deadbeat owners who don't pay until the last minute so they can use their timeshares. They take away valauble resources from the Assn in terms of staff time to collect and deal with attys, as well as necessary funds that must be paid to force these deadbeats to pay. If you think these losers deserve the rights and treatment as those who fulfill their obligations, please don't buy at our resort.

By-laws state that BOD may take any reasonable action to collect the fees. Many timeshares in our area deny use of the week even after the fee has finally been collected. (Again, some of that money goes to attys as well to pay for a tremendous number of staff hours needed to re-bill, co-ordinate with collection atty, etc.) Allowing full privileges developes a class of owners that drag the fees out for months year after year after year.
