No class action suit experience, 10 years of experience, a solo lawyer and the experience he does show on his site doesn't make me feel he could go up against Eichner and TMC...but who knows, maybe he could be another Matt Damon in John Grisham's The Rainmaker. I appreciate the sharing of this information, but I will continue to not put any more money towards this situation and wait and see what happens. Thanks again to Jeff Weir for his diligence in keeping abreast of this situation and periodically reporting on it. It is greatly appreciated by me. Gratitude towards Irene Smalls as well for all she has done.

The AG and the judge need to know that the owners are being held hostage to unscrupulous behavior and rising fees because it is impossible to sell our weeks. This investigation and lawsuit needs to be settled soon so the cloud is lifted from the MC.

I am new to this forum. I wish to thank Redweek.com to allow Manhattan Club members to get information on the MC Lawsuit. I will try to attend the Friday meeting at 2:30pm. I went to the last meeting scheduled for Jan 15, but, when I got there I was told that MC lawyers postponed the meeting. So, if this one is postponed again will someone please e-mail me? I recently received the MC 2017 Timeshare budget. I am surprised by the large amount MC charges for Management Fees, over $6 million. The budget report also mentions condominium charges. Can someone explain what these condominium charges have to do with timeshare charges? Thank you.

I'm also new to this forum and I too wish to thank Redweek and all of you have brought this issue into clarity for me. I personally have not experienced the unavailability issues however I am sickened about the astronomical annual fees and how those of us who do pay on time are basically maintaining the building for the MC. Their tactic of blaming the rise in fees and the lack of upkeep makes me furious. I'm from California so I only fly to New York twice a year and I've seen the suites go from clean and well kept to dirty and shabby. I'm consulting an attorney today to see what my option are. I'm tempted to stop paying the fees but I worry about what will happen to my credit. Anyone have any advice or comments on doing that? I feel like we are all being held hostage by this situation.

I just called the AG's office to confirm the hearing at 2:30 in Judge Rakower's court room. The hearing is ON for this Friday.

Also, TMC has hired the same law firm that obtained dismissals in the two previous class action suits to fight the new class action suit.

Today’s 3/11/16 NY AG vs Manhattan Club Hearing
The hearing today was powerful and exciting. It was Goliath vs Goliath. The lead TMC lawyer asserted the Eichners and TMC have done nothing wrong. The NY AG is conducting a fishing expedition and has found little to no evidence of wrongdoing. There are 21 people who though aware of the AG’s investigation are anxiously awaiting to purchase a Manhattan Club Timeshare and that right is being unfairly denied by the AG’s punitive stipulations and restrictions. The Manhattan Club is being harmed. It has been almost two years. TMC has provided thousands of documents, etc. They have had to layoff 100 employees. The TMC lawyers asked the Eichners and Scott Lager be taken off the complaint as personally liable.
Then the AG’s lead attorney Serwat Farooq got up. She stated the delays in the case have been caused largely by the Manhattan Club taking up to 8 months to provide requested documents. TMC has violated the court orders on several occasions. The case can be concluded much more quickly if as requested the Eichners and Scott Lager, the head of the management company answered the AG’s questions. They have all refused to testify or give a deposition. Scott Larger the titular head of Urban Management, the company that receives a 6.5 million dollar payment each year from TMC was paid by Urban Management. Urban Management had no employees. Scott Lager was paid $250,000 a year from Manhattan Club revenues. He was not paid by Urban Management. The AG’s office asked the 6.5 million dollar payment be held in escrow until the facts of the case were resolved. The AG asked for fines for and that TMC be compelled to comply with the court order. The AG also asked the Eichners and Lager continue to be held personally liable. for the Manhattan Club scam. The AG’s office talked about the hotel rentals being in specific violation of the Offering Statement.
And so it went back and forth between the two sides. The next step is for Judge Rakower to make a decision. The Judge specifically asked for a copy of the offering Statement to read it.
This is a very brief summary. About 20 TMC owners attended the hearing. I hope others who attended will give their summary as well.
