Manhattan Club Lawsuit
Yes, received a call....they want money upfront to list your timeshare for sale.....did some research and all info implies not to pay a marketing group upfront. He said my unit was worth $16,000 for a split week timeshare. I know that is untrue because you can't give these away.
got another lead on a law firm which specializes on getting people out of time shares. Lightly pursuing that option but have not decided to do that at this point till I do some more due diligence

I would avoid any Timeshare re-sale/rental telephone offers, especially if they're out of Las Vegas or Florida. They seem to be able to amass lists of T/S owners and work the phones knowing that there is tremendous dissatisfaction with T/S.I've received these calls occasionally for the past 7 years. They deceive you into believing that there is a worldwide market demand that begins around Jan thru March for the upcoming warm weather vacation season and they receive many requests for T/S. They also grossly overrate the value of your T/S. No individuals or charities want to take possession of your problem T/S.

I am looking forward to the day when the AG is finished with the TMC investigation and makes a decision good, bad or indifferent. I believe it is a mistake to call your TMC timeshare an "investment" and yourself an "owner". All you really own is the paperwork you've signed that is legally binding in court. If they foreclosed on your TMC timeshare , what would they be actually repossessing? Time? Good Riddance! If NYS/NYCwanted to seize the timeshare for your non-payment of your miniscule fraction of the property tax that is divided among the 15,000+ owners for 286 rooms. Is this actually possible? Especially the vague "Split Flex Time" (7 days over 3 years) ownership that I foolishly purchased in 2007. It's worse than a normal 7 day defined week timeshare. I've tallied up about $15,000. between mortgage, maintenance, RCI fees, & a lawyer a lot less than most dissatisfied owners. If T.Park Central,O. Park Central,The Manhattan Club Timeshare Association, Equiant Financial, New York Urban Ownership Mngt.the City of New York or the State of New York feel that this is worth anything feel free to take over my" ownership" and return it back to the vague, hazy legal hornets nest world it sprung out of .

thanks for the correction; i should have given the thieves more devious credit................how could i be more forgetful?..........of course "private accounts in tax haven" while we owners lick our financial wounds with currently no one coming to our rescue...

Yes! I just received this very same phone call from Jared Hayes three days ago. I've been doing research on URE and they have a C rating with the BBB but I think this is a total scam too. The fact that they want $1998 from the seller is a big red flag! I'm going to continue to do research on this company but I will not give them a cent. They claim if I agree to accept the minimum going rate, which is $65k they'll write me a check within 45 days. All the red flags came up for me....if it's too good to be true it most likely is.
rayr23 wrote:Did anyone else in the group get this call? The caller didn't give his company name, but a Google search of the number came up with Universal Resort Exchange http://www.urexchangeonline.com/ What is strange is that he initially called us at an unlisted private work number. Here is the voice message he left... "Yes my name is Jared Hayes and I was calling in reference to your timeshare property with the Manhattan club. And due to multiple request coming in for your location right now. I was giving you a courtesy call to do maybe an interest in renting out any of your unused time or interest in selling your timeshare property quickly. If so call me back. My number here is 855-420-8289. My extension here is 410. Have a great day."We are very curious.

don't pay them a penny UP FRONT. ACCEPT THEIR OFFER, GET AND CASH THEIR CHECK FOR $65k. DEPOSIT THEIR MONEY IN A PRIVATE ACCOUNT, AND THEN PAY THEM..............UP TO 10% COMMISSION FOR THEIR SERVICE. of course this scenario will never occur, but it's worth a try.............................BUT NADA, NOTHING, ZIPPO..............UP FRONT; SEE IF THEY'LL BUY THIS SITUATION.....HA, NOT A CHANCE.

In December 2015, a civil action was filed against TMC and amended to assert a class action on 2/22/16? Index # 654023/2015
This is separate from the AG suit. It is a private case. The attorney is identified. The court will have to certify the class upon motion of the plaintiff. It is not automatic.
This is all the information we have. We will forward more details when we get them. This information is from a TMC owner who is also an attorney.

Irene, I couldn't find anything for this index # on the NY Court website. Has anyone been able to find anything?

I am encouraged by the info on the lawsuit. It is a private lawsuit so we are not automatically involved but the clear option is there to have a class action. We want to help this lawyer because if he is successful that opens the door for us.
I am putting out an out call for a short list of TMC owners with legal expertise to help us assess this development and develop a strategy on how to leverage this development to our benefit.
We need to put more pressure on the NY AG. His office should be helping us more and informing us on what is going on. The New York AG is the people's lawyer and we are the people. My fear is that the NY AG will make a deal with TMC where TMC pays a few million dollars in fines to the State of New York and we TMC owners are left hanging without any relief.
We should also write Governor Cuomo. It was under Cuomo's watch that TMC was allowed to deepen and perpetuate their fraud.

Could anyone advice me what I can do about my case? Its about Holiday Club credit system (RHC), existing in tax havens with no real business there though. RHC uses Florida laws against American members. I'm Finnish myself and theres nothing I am able to do from here. I can't even use media from here...
RHC service center is in Mexico, but Mexico is not the case with me either. Europe Service center was not in help either. My contract was made to Americans, on which my citizenship was mentioned to be Middle East ( I look very Finnish :), never lived even abroad). There's so much details to tell in public why its nothing but a fraud at least in my case.
Just can't find any help.
I dont understand how RHC is able to function legally (?). From my point of few theres nothing legal in their 'business' with Wyndham included in Bahamas etc. different hotels. Memberships sold in Caribbean countries, but only middle hands selling those memberships etc.
Only registered company as rhc exists in two tax haven..
Its very odd case. Just because you guys ate on this trial, wonder if you knew any good advice.
Don4,
Trump means to me another clown :), but that's only my opinion. I'd never vote for him myself.

I spoke to the plaintiff's attorney, Lowell Sidney, this morning. He would welcome hearing from ALL OF US who are interested in joining his class action.
Phone number correction: the 212 number listed in his complaint is incorrect.
Lowell's telephone # is: 888-222-0513. His email is: lowell@sidneylaw.com
Everyone contact him ASAP!

This is what the would be class action attorney emailed me: "It's a $100 retainer fee to cover costs and whatnot, in addition to one third of any recovery. This will all be outlined in the retainer agreement." Most class action suits are contingency based, no upfront money. So he would make money win or lose. No thanks. By the way he is a "solo defense attorney" So this would be out of his area of expertise.
