Thank you so much for sharing this letter. I have been out of the loop in terms of reading this blog for the past couple months, but not doing anything. (We've only been "owners" with TMC since 2011, but only got to use our weeks once. Last year they told us our only option was to convert to RCI weeks, which we will not be able to use.) Anyway, I will send a letter this week and use some of your content. Everyone's feedback, advice and hard work is tremendously appreciated! Vicki Holst

Hey all, assume job on this thread, awesome job. Question, has anyone been given legal guidance on the paying of maintenance fees? I recall one of our fearless leaders stating she is only paying the tax piece.
I owe some more paperwork to the NYAG and will inquire when I submit. But in the meantime, I was wondering if any legal guidance has been already shared.

An attorney is looking at representing recent TMC owners (6 year owners or less) in a lawsuit. The statue of limitations is one of his concerns. The statue of limitations is 6 years. The TMC owners will not have to pay any money upfront. The lawyer is looking at taking the case on a contingency basis. I cannot guarantee the attorney after reviewing the documents will take the case but he is interested enough to look at the court documents. If you are a recent TMC owner and are willing to share the details of your TMC ownership please contact me directly with your information. I am putting together a list of recent TMC owners for the attorney.

They just did the same thing to us and with a bill for taxes also. Since there has been so much talk of advance billing by TMC I checked my contract and found that my anniversary date for maintenance payment isn't until JAN 2016!!! Not only am I not paying now, I don't plan to pay come January either.

I am donating my unit after 12 years of horrors. The process has now been a year and a half with consistent calling etc. My Deed and other documents had been filed with incorrect unit and lot numbers...dates spelling 'typos' etc. You may want to read through your paperwork and get it corrected with NYC before you jump to a next step. I had the orginal title company and agent still working and helped but they filed it incorrectly again after I got a 92 year old couple have to re-sign the Deed and notarize it ,too. Very confusing. Then if one number or address is wrong you start OVER. Re file completely again. We have now redone it 3 complete times and waiting for it to show up on ACRIS as evidence it is done! Then our nightmare is over. But the donation process has now been declined to accept or consider The Manhattan Club Timeshare due to my case. So gift it or keep up a good fight! Best of luck

re: the mc shareowners' meeting, sun, aug 2, 2015........... IN JUST 2 WEEKS ! we still haven't been told where this meeting will take place. owners need to know this, and the time frame of the meeting asap, to plan (hotels, travel, etc) accordingly. since experts , eg, attorneys, real estate personnel, home and timeshare owners' association officers and others as appropriate, will be available, a list of common MANHATTAN CLUB OWNER complaints should be presented to these experts to address overall to save some time and then to address any unique issues individually as they arise.

I hope that 92 year old couple understands what they're getting into.Things such as the ever rising maintenance fee ($2000. & rising) ,the difficulty making reservations due the club being oversold & the headaches its going to cause their heirs one day. If someone offered this to me for free I'd run. Your not doing them any favors but passing them down your headache. Not to mention the NYS Attorney General's ongoing investigation into the Manhattan Club that put a freeze on all transactions (sales,foreclosures,assets,etc). They are better off making normal hotel reservations themselves wherever & whenever they want to vacation. Nobody needs to "own" their own vacation resort room.These timeshares are set up to have the rules of real estate apply to them ( mortgages, deeds,maintenance,property tax) but you really don't "own" anything but "TIME". Check out the devious sales tactic videos on You Tube from the Timeshare sales pros & you'll get the idea.

The meeting is going to be around 1-2pm in midtown. Check earlier postings to get Jeff's email address to advise him how many will be attending in your party. Once they get a rough number of attendees, they will know how big of a venue to rent. I suppose the week bf the event a notice of location will go out to all who rsvp'd to Jeff.

The rooms will be open from 12-5 pm on Sunday Aug. Registration 1 pm Program 1:30-5 Snack break 3 pm
Confirmed attendees include representatives from the organizing companies, private attorneys familiar with the Manhattan Club investigation, a market researcher who studies resales in New York and, possibly, Attorney General Eric Schneiderman.
Schneiderman's office has been very coy --- evasive --- about accepting our invitation to talk with owners, so we are urging all RW forum readers to contact the AG's office in NY urging him to attend our owner meeting. Since the AG's case is a major topic of our forum, we think it only appropriate that the AG address it himself.
