Manhattan Club Lawsuit
Hello! Like a so many others I have been a disgruntle owner of a penthouse timeshare and like many others I have not paid my annual maintenance fee for the next year. Today, I was called by the MC financial department and was informed that I would not be allowed to attend the annual meeting if I did not pay my dues before the meeting. I realize that I may not have the right to vote but shouldn't I be able to attend the meeting. Have others, who have not paid their maintenance fee, been told that they cannot attend? I believe this is their tactic to control the up-coming meeting. Please, some feedback from someone.

I HAVE BEEN AN OWNER SINCE 2001. I STILL HAVE THE SAME EMAIL ADDRESS. I NEVER RECEIVED THE SURVEY. I WOULD LIKE ONE AND ALSO AN OPPORTUNITY TO EXPRESS THE CONCERNS AND DISPLEASURE IN WHICH THIS MEETING IS BEING ARRANGED, AND WONDER AS TO HOW THIS VOTE WILL ADDRESS THE PROBLEMS OF THE MANHATTAN CLUB. I CANNOT ATTEND THE MEETING, BUT WOULD LIKE THE OPPORTUNITY TO KNOW OF THE OUTCOME AS WELL AS THE ISSUES ADDRESSED AT THE MEETING.

Most all participants in this blog are requesting that they be "included in the TMC lawsuit", they are requesting that they be "added to the list" of disgruntled and generally are concurring with our list of complaints.
Be advised that, according to the NYS Attorney General's office, they do not read or monitor this blog in any way! Your requests to "join in the lawsuit" are not heard by anyone in any authority and your name will not be included in any action.
Instead, what everyone needs to do is formally register their complaint in writing to the AG's office. That is the only way you will have any effect on the pending investigation. If you received a survey from the AG - complete and forward it. If you did not receive a survey, write a letter of complaint. Now is the time for action! Address your personal complaints to NYS Attorney Farooq. Make the effort or forever hold your peace!

I agree that we all need to be loud and persistent with our frustrations and complaints against TMC. I personally submitted the AG's survey, but I also mailed a lengthy letter to the AG describing everything from the sales experience to my current inability to get a reservation despite paying exorbitant maintenance dues. I am also attending both meetings in August.
Everyone that is reading and contributing in this forum should also be inundating the AG's office with letters so they know there are hundreds if not thousands of owners seeking some type of restitution. Perhaps we should also start writing to the media.

hi jamesg658, i thought i kept somewhat abreast of the AG'S/TMC lawsuit. to date, i don't recall hearing of any " counter claim filed by the AG." pls inform me about it, and if you find out more info pls forward to all of us MC shareowners.

Agree with you lenap3. There are a relative few TMC timeshare owners that are even aware of this blog which makes it even more important for each and every owner to write and submit a complaint to the Attorney General. A favorable result is not going to just happen via wishful thinking, or even justice necessarily. All readers must take the initiative to submit their own complaint if they want anything in return for their hard-earned investments.

I see some of the issues listed that will be brought up in the August 2nd meeting, as mentioned by Kylie in today’s email.
As far as I can see and I have kept up with all communications since I discovered there was a blog, etc last year, I seem to be the only one that has brought up the inheritance issue(s). I inherited two timeshares 2 years ago when my mother died.
Anyone who owns a timeshare should realize that as an owner, if you die, these go into your estate. Therefore one’s heirs will inherit this mess and as it stands now TMC can continue to demand fees from the heirs and /or the estate.
We did estate planning and I asked if you could take these out of our will/estate and we were told no, that it is an all or nothing situation. Our estate planning lawyer urged us to get rid of these timeshares as soon as we could. She said they will be a nightmare for any executor/heir.
As I shared, I gave one back to the club, and was waiting for the transaction to go through when the AG’s investigation put a hold on that last July (We were able to write it off on our taxes as a loss).
And I own a penthouse and of course waiting to see what happens, as I can’t do anything about selling/giving it back anyway at this point.
So, I would urge that this topic also be included, because it is relevant to all owners and their heirs/estates and a topic that I believe most are not even thinking about or considering because they are focused, understandably, only on the other immediate issues.

I follow this issue and once the estate attorney sends in proof of death to TMC with a request to give the unit back, they apparently always do so if they are asked.
I've been in contact with many owners via private email with questIons regarding this topic.
Also, on NYC ACRIS website (where all our documents are listed such as the Deeds and Powers of Attorney we unwittingly signed giving free reign to change our Deeds as our legal representatives- slick move), it often shows change of ownership from estates back to TMC.

My personal and real experience after inheriting 2 timeshares at the club, over 2 years ago, is not what you are describing below, far from it.
You say they "apparently" accept back the timeshare with a death certificate and a request. That is not the reality, at least not what I experienced. I am not going to waste my or anyone elses time describing what I went through.
And because of what I experienced, I am trying to help, and that is why I am suggesting that in addition to the other topics being discussed at the August 2nd meeting, this topic (of wills and inheritance re: the timeshares) be addressed, so perhaps real answers can be obtained and people know where they stand in this regard, and what their options are.
