I contacted BBB also, no response from them. I guess unless we have pictures of what the property use to look like and what it looks like now we don't have a leg to stand on. Believe me I would like nothing better than to put these people out of business but so far no one has proven them wrong. The people on this web-site who have contacted the lawyer hasn't gotten anywhere either, just lost more money. I live in Va. matter of fact right down the street from LandOr. these people have better lawyers than you or I will ever be able to afford.

I will be in Henrico District Civil Court for my "trial" November 14. I do have pictures from 1988 when we signed our 40 year contract! My 30 year old daughter went to Club Land'or this past summer and took pictures on a "walk around" and is coming along to court as a witness to testify as to how run down the property is now. I believe that Land'or has breached the contract with all the assessments etc and am flying into Richmond from Minnesota to have "my day in court!" Wish me luck! Court is at 11 AM. Good luck, I'm sure a lot of people will want to know how it goes. Glad you guys took pictures, maybe after this is over you can send them to the BBB, let them see how people are being ripped off. Christine, I plan on coming and will offer what ever support I can. kltrink@comcast.net if you want to connect before than. Be advised you will not be allowed to take in your cell phone or any sharps/weapons- just like airport security there is screening process and purses are searched. Make sure u know which building you are going to. Allow time for parking.

BBB is a joke. They have been in the news a lot lately as to their objectivity. Here is the result of my complaint:
At this point BBB has determined there is no further action to take. While we understand you are not satisfied with the company's reply, it appears Land' Or International has clearly explained their position in response to the disputed issues. Your complaint has been "Administratively Closed." This means the company has provided a specific response to the issues you brought forward and in some cases provided proper verification they have no obligation to make an adjustment. We have closed our file on this complaint. If you wish to pursue the matter further, you may wish to seek legal advice.
Here is the definition of holdover from USlegal.com:
A holdover tenancy is the situation when a tenant of real estate continues to occupy the premises without the landlord's consent after the original lease or rental agreement between the landlord and the tenant has expired. A tenant in this situation is also referred to a tenant at sufferance. The tenant is responsible for payment of the monthly rental at the existing rate and terms, which the landlord may accept without admitting the legality of the occupancy. If a holdover tenant is does not leave after a notice to quit (move out), he/she is subject to a lawsuit for unlawful detainer. A holdover differs from a tenant at will in that the latter has permission of the landlord to stay beyond the expiration date of the agreement, while the holdover tenant does not.
I was specifically challenging the new Energy Surcharge/Holdover charge. Club Land'Or did not even address these in their response. I will be calling BBB to see how they will record my complaint in their reporting statistics for Club Lan'Or.

I, years ago had no luck with BBB. Think about this - I have been on this site since the beginning, before I went to court and got out of my contract. I wanted to help others after I was out and I was the one who found the attorney, Mr. Sadler, whom many have spoken to and worked with. Now, I have seen many comments on how that must have been useless. How can you say that - you don't see them making comments on here any longer do you? Hmmm I guess they must have had to sign some sort if gag order. I know several people who were told to take their postings off this site by Club Land Or if they wanted out of their contract. Anyhow, just know there are behind the scene things always going on. If I can find out what has gone on with the cases represented by the attorney I will post soon. In the mean time everyone should go back to page 1 and see if there is any help in earlier postings.

I called Land'or Nassau yesterday (from US dial 1-242-363-2400) to inquire about the "proposed elevator" that was suggested to be built. It was never built. If anyone has any letters from Land'or that talks about an elevator being installed, I NEED that information ASAP for for court Nov 14. I also asked when the last room rennovations were done, and the office gal sort of chuckled and said that question she simply could not answer!!! I think I know what that means, but if ANYONE has actually stayed at Land'or in the past year or so I really really need your help! It looks like the Land'Or Williamsburg property was auctioned off - may be able to check city website under property sales, city assessments, etc. (Virginia Beach or Williamsburg) and find out. Maybe the Virginian-Pilot or the law firm could provide info. Would love for the Bahamas to be sold!

I will also try to attend your court date. I agree with the other person (kt?), that many people should try to be there for support. I may be there soon - I finally quit sending them money.
Even though it is not factual info, I was wondering if you brought all the complaints from this website and complaints filed with the BBB, if it would help.
I am pasting info I received from the lawyer, Mr. Sadler, regarding a legislation hearing that took place in August.
I have learned from an article by Anne Marie Morgan on Va. Public Radio that there was a hearing to see about proposed changes in Virginias Time-share Act. Unfortunately this hearing took place on August 15 before I heard about it and it was attended by Frank Eck and Philip Richardson, both lobbyists for the time-share industry. Frank was the lawyer who drafted the documentation for Club Landor. This is your chance to have input on legislation in which you are vitally interested.
I have my list of problems which I am happy to share should you be interested they include stronger enforcement to protect against false and fraudulent sales practices, over selling, endless special assessments, renting out time-share units and charging expenses to the association. My current list is 18 items and growing. Most important is that you take a moment to tell the committee members what you think needs fixing. It is not my opinion that is important, it is yours.
Please take a moment and communicate with the legislators writing this legislation. I set forth their contact information below. Please copy the executive director as well as she will be responsible for coordinating the input into the stature. If you can remember, please send me a blind copy of what you send. If you know anyone else who might be interested in this legislation, please let them know as well.
