Manhattan Club Lawsuit
Trust but verify. To the best of my knowledge: we have yet to learn who the new buyer is. I don't believe the transaction has been completed yet. I agree we need to give that person or entity a chance to present to us how they plan to move forward. If the new owner plans to continue to run business status quo (ridiculous maintenance fee rates) they can hand my account over to what ever collection agency they choose. I'll fight them long before I continue down the current path. I agree the AG and TMC came to an agreement. I didn't agree to anything except to sign a contract that the AG has proven should be invalidated.

William, you continue to verbally bully those of us who have stopped paying maintenance fees into doing so because you obviously think that it will somehow help those of you have paid all along. What's important, and obvious to those of us who finally realize that we will never see our timeshare again as we knew it, is that the settlement only covers the years 2011-2014 and during those years my maintenance fess were paid in full so I "may" benefit from some settlement funds, which at this point I doubt. What I refuse to do is pay another hard earned penny to the Eichner's for the past year that I have not paid. How foolish and ridiculous to even try to justify paying another penny to these crooks! And quite honestly, I could care less if they try to ruin my credit however I get the distinct feeling you would love for that to happen to those of us who haven't paid. I'll never see my $59,000 "investment" again, which is what I paid for the "Penthouse Suite" which looked like a cheap hotel room the last time I stayed there. It was dirty, the furniture was shabby and broken down, the carpet was filthy, and I had to practically beg for towels and sheets. I have personally written off this "investment" as a total loss. So, with that said, I have moved on and I've learned a very valuable lesson to NEVER buy a timeshare again.

Bravo Becky. We had ours bought back for $200, and now I realize how lucky we were. I applaud those who have stopped paying and I would consider the yearly savings as a partial return on my lost money. There will always be those who stick up for the abusers and blame the victims. I'm not sure, but I think that if your credit is affected you can challenge by giving evidence. Your inability to book a room being the biggest one.

I am the executor of an estate that a unit is in. I have paid the dues since the estate went into probate (2015). I have booked days for friends (never had a problem getting days). I am going to pay for 2018 in hopes that the buy back will come into effect and I can close the estate. Have any of you had experience using Redneck as a rental go between. I see they advertise that they can do this. Tim

What do you mean bully? I said, "I suggest." Reasonable people can disagree without name calling. Just be careful. Fighting poor credit is not easy.

In 2003 my father purchased 1bd/2ba suite at TMC for $17,921 and paid cash. I have the deed and contract. It was deeded in his name only. He passed away 10/25/2016 and my step-mother passed away this May. Are my siblings and myself responsible for the bi-annual dues? We never used it or have any interest in it, we all live in different States. I paid SMTN $1,498 to try and sell it, no luck in the last 10-months. We just want to get out of it, any suggestions or help would be greatly appreciated. Sheryl

I would be interested in joining. Deeded Unit #1202 inherited last year, never used by anyone except my Dad & step-Mom many years ago. He paid $17,921 in 2003. My father and step-mom have both passed away. There is no interest whosever from any of the heirs, just want out. Sheryl p.s. I paid SMTN $1,498 to try and sell it since I am the only surviving Trustee/executor and have had no luck.

nathanz2, i agree with your factual comments to a limited extent; however, please acknowledge our differences; you were kind enough to say that the settlement was "unsatisfying'" my statement is that it's a full-blown cop-out on schneiderman's part. my opinion is that he had enough, and whatever the so-called settlement is, he took it and walked away with a victory (of sorts.) now justice has been served leaving us with virtually nothing. eichner got a tap, NOT A SLAP, on the wrist and a finger point with a "naughty boy! now you can't be in the timeshare business any more".........................and his genius business acumen is prompting him to think, "oh, sure i can. i'll just use a phantom company just as i did with urban. i know just how to work the system," and presto, he'll be back in the business again if he wants to, only his name won't be on any of the legal papers to incorporate as a timeshare developer. WELCOME TO "THE CENTRAL PARK CLUB" or some other appealing moniker for his new venture. as hamilton, aka, lin manuel miranda sings: "I AM NOT THROWING AWAY MY SHOT...........JUST YOU WAIT."
my opinion again: you"re so right about thinking that a takeover company will "make right" what the original Manhattan Club sponsors did wrong." however, i'm persistent and a pain in the a++ enough not to give up on that premise. i haven't been trained to roll over and play dead. we TMC owners have had enough sh++ thrown at us by sir eichner. should we await a new management/ownership company continue to do so? THAT'S NOT IN MY LINE OF THINKING.

in unity and victory,
chris
nathanz2 wrote:Thank you, Kevin. As unsatisfying as the settlement may be, it has been accepted by both parties and is now being implemented. My only hope is that everyone on this thread commits to working with the new management rather than bringing all their issues along and expecting that the new management is somehow going to "make right" what the original Manhattan Club sponsors did wrong.

fibon,
my respectful admonition: PLEASE WAIT FOR THE TERMS OF THE SETTLEMENT (as crappy as it may seem) before you give away your POSSIBLY very valuable TMC timeshare investment. you braved the fraud and scam thus far; why not wait for more info before you make a losing financial move?
unity and victory,

I agree, check with a lawyer, a good lawyer. It may depend on what State you live in. My experience upon inheriting 2 timeshares was, as the inheritor and executor, I was responsible for continuing to pay the fees. I live in Massachusetts, my Mother died in Virginia and the timeshare is in NY. In Virginia I was required to pay a bondsman (along with 3 lawyers, one for each state) to insure I would follow through with the terms of her will. While most everything had been arranged to transfer to me, a few things like the time share did not and became part of probate in Virginia. I was required to file an ancillary probate in NYC and pay real estate taxes to NY. That necessitated paying a huge fee for a company to evaluate the worth of the timeshares, which I knew were worth nothing. They accessed one at $30,000 and the other at $20,000. I gave the cheaper one back to the club for $100, haven't seen the final paperwork or the money, but I was able to write off a loss on the one I gave back. All in all an awful nightmare !...And another lesson on how our system can rape one financially ad infinitum.

Hi Chris, I haven't been trained to roll over but I have been trained to use my head before I use my mouth. I'm not inspired by politically correct, historically inaccurate musicals. I'm not a lawyer, so I don't give legal advice. I don't pay your bills, so I can't tell you what to do with your unit. I don't know how it helps to call the AG names, so I don't do it. I don't know how it helps to start a letter writing campaign after the matter has been settled by the AG, so I won't do it. I don't know who people are talking about suing in Small Claims Court, but absent a sponsor, owners pay judgments against the MC, so even a win is a loss to us. Chris, I agree with your self assessment. But Eichner and the AG probably don't know you exist. You're just leaning on cap-lock, thinking you're being "inspirational," when what you're doing is venting non-stop and giving out questionable advice which is only taken seriously by people who don't read more than the first and last page. I think this thread had outlived its usefulness and wish Redweek would just shut it down.

Nathnsz2 Why take everyone's forum away? Unless you're a totalitarian. I'm not even going to address the "bitter" thing. lol. I don't recall calling you any names, so can the insults. Once more, if it annoys you so much, don't read it.
