I will send copies to those that ask. I do not know what years they used this paper. The power of it exists because any contract is governed by the language in it. "Special assessment" is not defined in the contract. It is outrageous anyway, because using their definition, they could send us all a bill for $1,000,000 if they wanted to. However, on this questionnaire, it asked specifically whether I understood that I would have to pay the maintenance fee and "special assessments levied by the Bahamian government". This would show that we had an understanding, at the time of signing the contract that that is what a "special assessment" is.

None of the special assessments had anything to do with the Bahamian government.

Would anyone reading this blog want to come to my trial and testify against Land'or or just support me in my fight against paying any more money to Land'or?? My new court date on Nov 14 is a trial, in Henricho District Civil Court, Richmond VA.

Who did you contact at Club Land'or with an offer? What kind of offer? What ever happened with this? Was it resolved and how. Just received another special assessment.

Does anyone know how to get a class action started or some other legal action to reclaim extra fees and stop these fees.

Seems like a breach of contract to transfer maintainance fee expenses that are capped at 8% per year to a special assessment. Also the contracted noted 72 units available (per week) for use but 2 of the units ( total of 142 weeks are owned by the president or his family and not available to timeshare members. Another breach of contract? Are these unavailable units paying the assessment and all of the special assessments all this years? .

Does anyone know how to get a class action started against Land'or

Did you know about the my posting below. regarding the 144 weeks - 2 units for the exclusive use of the president and his family, maybe even his friends.

Just found on a google search where the BBB (of Virginia I think) has 30+ complaints against Club Land'or. The more I think about this the more I want them to pay me/us for taking advantage.

I don't understand how people are getting bought out of their contract, we have contacted Land Or and they tell us "we are not in the business to buy back contracts". We have paid ours off and offered to "give" it back to them or see how much it would be to get them to take it back, they will not deal with us (if we were behind in payments I think they would). LandOr has embarrassed us by calling family members when we don't pay the assessments on time, I just think we are all screwed... I live in Va.. I just don't think it's worth my time going to court, these people have everything covered in their contracts...

Yea, right. I have been trying to get out of this since very shortly after buying since there was some fraud in the sales meeting. I unfortunately, did not have them answer my questions during that meeting in writing so lesson learned. I have not paid in over a year so I expect to hear from their legal department soon. I don't care who they call. My friends and family all are aware by now of what a dishonest company this is.

I understand how you feel, but Club LandOr will get their money. We tried to sell through people who sell timeshares for you, well that was another 500.00 wasted, still trying to sell after 5 yrs of paying this company, we give up!!!!!!! We are just going to file it understand "the stupidest things we have done in our lives" thank god it's not a deeded property

I believe this may be a violation of federal law. It is certainly worth a check.
