i am interested in joining, i previously launched a complaint with Bank of America and American Express but this was back in 2009 and not many had been burnt yet. now that i have sufficient evidence of this scam i am going to request a review of my previous complaint.

Thank you for taking my call today. As I told you, it has been very hard for me to get in touch with most of the petitioners, because of limited contact information. In respect to the Petition Letter dated May 25, 2011 (Attached), that you undersigned in support, and which contained several complaints from purchasers of the timeshare development commercialized as Bel Aire Puerto Vallarta (Now Hotel U), I would like to inform you that:
The Asociación de Desarrolladores y Promotores Turísticos de Tiempo Compartido A.C. (ADEPROTUR), (Timeshare Council Association) expelled the Bel Aire Developers from the Association because of multiple complaints due to nonperformance on their part in their duties as timeshare developers. In addition to the above action, ADEPROTUR also requested the cancellation of the registration of their timeshare Adhesion Contract before the Procuraduria Federal del Consumidor (PROFECO) (Federal Consumers Protection Agency) seeking to restrict them from selling timeshare units. Our law firm was contacted by the Timeshare Council Association, to pursue further action against the developer and remedy for the purchasers, beyond the scope of the authority of the association. Class actions have only recently become a reality due to several legislative reforms that establish the possibility of exercising them. Class Actions in the Mexican legal system, have their particular characteristics, however, in essence, they have the same purpose as in other legal systems, that is, to protect the rights of people in a certain group. These reforms were published in the Diario Oficial de la Federacion (Official Diary of the Federation) on April 28, 2011 will become enforceable as of March 1, 2012.
Our proposal for further action against the Bel Aire Puerto Vallarta development is the engagement of an Individual, Homogeneous Class Action, seeking to sanction the nonperformance by the developer that undersigned the timeshare agreements, received payments for these, and generally failed to perform in their obligations.
Pursuant the case study made of each individual case of any participant; we are certain that we will find elements that demonstrate harm to the property of the consumers due to the fact that the timeshare services that were effectively purchased and paid were impossible of being used by the consumers.
Each participant is important for the success of the class action. Don't listen to all the negativity. Be glad that you bought. This all steel building is a new design, one of only 3 in Mexico. It's state of the art. Look at it, it's not concrete and rebar. These are steel beams. The entire building is all steel beams. Wait for a big hurricane. You'll see this building still standing while some others won't be. They had to go down 60' before they hit bedrock. What kind of footings are those other towers sitting on?...Think about it. These footings are 7 stories down, in the ground. That's great anchoring. I know I'm going to feel pretty safe. I'm not connected in any way, shape or form to Bel-Aire. I'm just a Canadian tourist who bought into it. Yes, I was very concerned when I read all these postings. But I go down to PV twice a year. So I check it out when I'm there. It's being built. What more can I say. Don't get all in a panic from reading the negative comments. You'll lose sleep over it, but not your money.....Get yourself informed....keep informed. Go to their website and look for yourself. My wife and I were there in December and there was no work being done...nobody or any sign of life...vines growing to the first floor....windows so dirty on the first floor from weather, the perimeter fence condition shows that no one has been on site to do any work... this is dead in the water.....the guard at the spa wouldn't let me talk to anyone inside and they haven't replied to my e-mail either....The guard gave me their card with their phone number and e-mail address....

You have a great idea. Would you like to take the lead? I think if there are quite a few people unified approaching the Credit Card Companies the chances of being heard would be a lot greater. It should't matter if its under 2 or over 2 years old.

I have just had a conversation with B of A about this issue and they conveniently told me I could not appeal their decision of unable to assist from Jun 1, 2009 because of time frame. i will not be using B of A for anything in future and will be sending them a letter. I'm sure they will be very disturbed. i wonder why the masses are fed up with big banks

I don't think that I am the one to take the lead in this situation. Capital One told me that although we do have a proven legitimate claim, they do not have the necessary "back end" information in their system because of the time delay. Our reason for waiting was based on trying to give Belaire every opportunity to fulfill their promise to us. Our contract clearly states occupancy 2010. We purchased July 2009. If anyone else has used Capital One for those charges, contact me and I will gladly give you info. Perhaps if we continue to try , someone will accomplish this in our behalf...or at least get some of the funds recovered.

I AM IN PV RIGHT NOW. TESTERDAY I WENT BY OUR WHAT SHALL ICALL IT THE TOWER. IT SEEM THAT NO ADITIIONAL WORK HAS BEEN DON ESINCE LAST YEAR. T6 ODAY IS THE 5TH ANV. OF THE DATE IBOUGHT. WHISH ICOULD GIVE ALL BETTER NEWS. I PLAN ETO MEET WITH THE LAWYER THIS WEEK. TO TALK ABOUT THE CLASS ACTION THAT WE WANT TO STARTS AFTER MARCH 1.

A class action suit is a good idea but that won't stop the crooks from bilking more unsuspecting visitors to PV. The chance of getting any money back is years away through a class action suit but I think that is something that should be started. If you want to stir the pot and do more harm to these jerks then use the Internet. Red week is just a start. Facebook brought down a ruthless government. Go on Face Book and any other Social Network and voice your outrage with these losers. Make a stink... Contact your local TV or Radio Stations. They are always looking for a story to promote. These crooks rely on the fact that people are embarrassed to say that they were taken advantage of and coned out of thousands of dollars. Take away the tourist dollars from PV and watch how fast the government gets involved. Granted we all need to get together and do something so if you want a leader then contact me I'll stir the pot and kick this off. What you were promised, when you were told the building would be completed, purchase date, how you paid etc. I have watched and read all these comments from many people who have been affected by all this and it is time to get together and get up off our butts and do something!!

The reason that many people feel this way is because many of the timeshare "resorts" are now applying NLP (neuro-linguistic programming) into their sales pitch! So, many people don't realize that they're being manipulated to making a purchase to something that really doesn't make sense to them.
Even when people attend a presentation with "their minds" made up that "no matter what, they won't buy anything", they end up buying and then they wonder how that happened!
Most of the timeshare companies have big training manuals and videos on how to sell to "different" customers. So, many people really don't stand a chance when dealing with sales reps that have received hundreds / thousands of hours of training with NLP selling strategies.
I sure hope that this message gets read by as many people because people have got to become aware of this!

Stay away from them!!! Nothing is for free! Your "gift", your "breakfast", are not "free".
Promoters will now even pay you real cash to attend a presentation!!! (I've witness promoters paying up to $400 USD for a married [qualified] couple to attend a presentation!!)
Please stay far away from any timeshare / private residence club promoter.
Timeshares are a BIG fraud! If anyone has already purchased, be aware that (in many cases) you can still get your money back!
PROFECO will help you, even after the 5 day period! They will help you up to 365 days after your purchase! So, it's very important that you contact them as soon as possible. The timeshare / "vacation" resort will try to fight it (since they have already paid out the 40% commission that's paid out to the sales team -- management & rep; the other part goes to the resort owner/s) but PROFECO will back you as long as you're willing to get your money back!
ALL timeshare companies in Mexico are afraid of PROFECO because they all know that they're committing FRAUD and they all want to avoid an audit by SAT (also known as Hacienda - the IRS of Mexico). So, the more complaints that a company receives thru PROFECO, it will trigger an investigation. And, to avoid this, the company WILL refund ALL / most of your money.
The Belaire Golf Resort and Spa is one of the biggest frauds out there!!! There is a BIG reason on why they take their time on "building" their resort(s). And, it is just smoke and mirrors! If anyone has "invested" any money into that place, please contact PROFECO ASAP and get your money back.
If anyone has "invested" money into Grupo Mayan (also known as Mayan Resorts, Grupo Vidanta, Vida Vacation Club, and many other names) also contact PROFECO! There is a HUGE reason on why this company keeps changing their name every other year! The reason is that it basically voids all contracts made under other names!!! Also, when people do revisit the resort, guess what? . . . contract renewal -- and that means another sale and they'll take more of your money!
My recommendation is that when anyone does travel to Mexico, use your time to really enjoy your vacation with your loved ones! :)

what a load of crap . . . NLP???? More like the greed factor kicked in !! Time share of any sort - vacation ownership etc are USE programs NOT to make money to retire on. All the complainers I've seen writing in about various programs bought for GREED1

Are you serious? We paid them Thousands of dollars and have purchased a time share in Mexico before that we have used for 15 years and it has been wonderful. Time shares are not cheap they are just more cost efficient then purchasing a vacation every year. I have purchased preconstruction before just down the road without any problem. I dont consider the $50,000 they charged me greed on my part, that was a lot of my hard earned money, you are an idiot. Pretty easy to put down the honest people who purchased with real cash when you are not one of them, go soak your head.
