To whom it may concern: class actions are not brought by plaintiffs, they are brought by lawyers; and they are brought after the lawyers calculate how much they are likely to recover, how long the case will take, and how much it will cost. It’s about economics, not justice.

pls think positively and help us get ready for a counterproposal if a crappy one is presented to us. if you let it happen, and don't put up some kind of counter, then you simply accept and suffer the loss and whimper. come up with some creative ideas for a counterproposal for a possible unacceptable one from the so-called settlement.

if you're referring to the board members while eichner was head of the motley crew, THEY'RE GONE BY COURT ORDER.
we need creative ideas as a counterproposal to a possibly unattractive settlement to make us financially whole after the TMC/EICHNER'S MASSACRE AND FRAUD-RIDDEN DUMPING ON ALL OF US OWNERS. HELP.

you're right: "There is no class action lawsuit in progress." what i am trying to do is to consider a class action counterproposal in the event of an unattractive financial settlement after the nysag vs tmc/eicher lawsuit. we need creative ideas in order to present a unified front to whoever it is that offers us a settlement if we deem it unworthy to make us owners financially whole after eichner's dumping fraud and scam-ridden financial actions upon us oiwners. YOUR IDEAS, PLEASE

The "AOD" is up on the website of the NYAG. (https://ag.ny.gov/sites/default/files/manhattan-club-aod_0.pdf) It contains the details of the settlement, which according to my quick read, breaks it up over the next 2 years (50% now /25% in a year/25% in two years). The first payment is based on how many days in 2011, 2012, 2013 and 2014 paid-up owners were unable to use, and the final two payments are will be made to paid-up owners based on the proportion of their maintenance fees (for those who paid their maintenance fees) to the total maintenance fees charged. It's all in paragraph 69. So half of it has to do with compensation for loss of use and half of it for overcharges to owners who continued to pay their maintenance while others did not. There is nothing here for any other losses, real or imagined. Anyone who stopped paying their fees will not qualify for the settlement. But I'm not a lawyer, so perhaps Jeff can impose one more time on his legal consultant and ask him to interpret for us.

There is no good, or right answer. If you continue to enjoy the place you need to decide if you want to potentially jeopardize your 'good standing' during the pending changes in ownership & management. On the other hand, if you haven't been able to get time, and/or the fees are no longer affordable then ...

You have to make your own decision. Having said that, the MC sends out bills far in advance, so your bill is probably not due until Jan1, and even then you probably have a grace period. Next, $2600 is $371/night. It's no bargain, but not bad for a suite in Manhattan. So do you like the MC? Probably not right now. But if you would like the MC under new management, possibly with more reasonable fees, consider paying it at the last minute. But for now, just wait and see what develops. These maintenance fees were developed by the old regime. The settlement does not overturn contract law and we each signed on to pay maintenance fees. I suspect the "new" maintenance fees will be lower once a new management company is in place and fewer owners default on their annual obligations.
