Jeeze! "Alex" was banned from this forum at least a year ago. A) for a bogus identity and B) for soliciting. I am mystified how & why people are still seeking "Alex", or even know about him/her, and an email from a year(s) ago.

Chris, so far, AG not disclosing any details of settlement or next steps for owners. People seeking information have had to file Freedom of Information Act requests to get access to documents. AG's actions inexplicable in light of their public obligation to represent consumers. They have not responded to RedWeek requests for additional information that would be informative to owners. Very unfortunate!!

hi jeff, ok............FREEDOM OF INFORMATION ACT...........any ideas regarding what information (documents) to ask mr schneiderman for by using this legal right? personally, i wouldn't know where to begin. i know what info i and the rest of owners need:.............WHERE DO WE GO FROM HERE? however the specific (and legal) information to request remains cloudy, since there may be several questions from the variety of people in this forum, ie, from their own personal viewpoints and situations. you're probably more familiar concerning the wording of the questions that we, in general, should ask. the individual specifics would follow from our varied perspectives. pls try shedding some light, from your experience and point of view, on this matter.

Hi Jeff, the court filed the following documents in September 2017:
Sept.05 - STIPULATION - WITHDRAWING MOTION/ORDER TO SHOW CAUSE - BEFORE JUDGE; Sept. 08 - STIPULATION - SO ORDERED; Sept.13 - ORDER - OTHER; Sept.14 - STIPULATION - DISCONTINUANCE (POST RJI) Any thoughts on that? Your comments are highly appreciated. Thank you

Jeeze! "Alex" launched this forum SIX (6) YEARS AGO and asked to fill out the attorney's Survey for the Class Action that was opened back then by the attorney Blau. When "Alex" buy backed his interest, the owner posted several 'good buy messages' and that happened before the NYAG investigation has started. Thanks to his forum thousands of owners united and shared information. Instead of blaming anyone, just change the title of the forum! have respect to people.

Those of us who have been reading & contributing (every day) can get frustrated by those who don't read postings, and only visit annually.

The stipulation, filed by both sides, formally ends the AG investigation of the Manhattan Club business practices. It was filed with prejudice, which means the same claims cannot be reasserted. While the case is over, most of the ongoing owner issues remain to be resolved and explained by the AG.

I followed the instructions posted on this blog and left a message for Mr. Solomon, who returned my call and patiently explained as much as he was able. The NYAG is not acting as an attorney for individuals and cannot give individuals any advice. The following are not a direct quotes and are my interpretation only.
(1) The MC has not been charged with anything. There was an investigation which resulted in a $6.5M settlement and a change in management. (2) The settlement will not be administered by the AG, but by an administrator selected by the new management and presumably approved by the AG. Think of someone like Irving Picard after the Madoff scandal. (3) MC owners will be contacted by the administrator. If you want a copy of the settlement agreement, you can submit a FOIL (Freedom of Information Law) request to the NYAG's office online. That will add your name to the list receiving copies WHEN the information is released. (4) The settlement applies to all purchases made in New York regardless of the buyer's state of residence.
This settlement still has a long way to go before anyone sees compensation. And as frustrating as that may be, the NYAG has accomplished more than any of the other suits brought to date. And even if the compensation is small, the fact that a cloud has been lifted and good management restored should return some liquidity to our MC interests.

Very interested in sales opportunities. I am wondering when the moratorium will be lifted for selling/buying units. Do I have an offer/deal for that very interested in Manhattan vacation location buyer! Positive! That's how I am going to stay. Believing for the best!!!

Thanks for your kind words,Jill's. Mr Solomon is head of enforcement in RE division at NYAG. See p. 159. Everyone else: the only people who benefit immediately from the settlement are the Eichners. Their liability is capped. Owners still need to wait for appointment of an administrator, retention of a new management and publication of the criteria used for the settlement. By the way, nobody works for free, so I'd expect that $6.5 M to shrink a lot before we ever see any of it. So do yourself a favor and stop asking questions that can't be answered, like when can I sell, and stop sniping at each other over distractions. We're just entering Phase 2. Hopefully it will be a lot shorter than Phase 1.
